ASHLEY BURKHARDT TRAINING ACADEMY, LLC
RELEASE AND INDEMNIFICATION

The sport of softball, including games, practices, courses and clinics
(“Events”), involve activities which may include risks such as, but not limited to, falls, accidental
or intentional forceful contact with other participants, spectators, and equipment, effects of
weather, traffic, and other conditions. In consideration of __________________ (“Participant”)
being allowed to participate in events conducted and/or sponsored by the Ashley Burkhardt
Training Academy, LLC, (the “Sponsor”), I hereby expressly assume all risks arising out of
Participant’s participation in any such Events and related activities.
Although facilities, refreshments, and other assistance may be made available during
Events, I am solely responsible for Participant’s health and safety. I represent and warrant that
Participant is physically fit and able to participate in all Events and related activities and I agree
that Participant will stop and request assistance if Participant experiences any symptom such as,
but not limited to, dizziness, excessive fatigue, shortness of breath, pain, injury, or any conditions
which would make it difficult or unsafe to continue.
I agree for Participant, myself, my spouse, my co-parent, all of our heirs, executors and
administrators, to release, indemnify and hold harmless, the Sponsor, their affiliates, members
officers, directors, coaches, volunteers, and employees, and all sponsoring businesses and
organizations and their agents and employees, from any and all liability, claims, demands, and
causes of action whatsoever, arising out of my participation in any and all Events and related
activities, whether it results from the negligence of any of the above or from any other cause.

This payment includes an initial cost of $197 and will include a recurring payment of $97 every 6 months hereafter.

If your are not satisfied with this product, you can receive a full refund within the first 30 days of purchase. If it is after 30 days when you would like a refund, you may not be granted an entire refund.
